Economic Espionage Act of 1996

The federal government will protect a company's trade secrets by imposing penalties against any person or entity that steals or discloses the trade secrets. These protections are only available if the company takes reasonable measures to preserve and protect its own trade secrets. As a result, improper documents disposal could result in a loss of this Acts protections.

Heath Insurance Portability and Accountability Act of 1996 - HIPPA

This law protects the privacy of patients health records by imposing limitations on the use of and disclosure of these records for health care providers and health care insurance and billing services. Failure to properly secure and dispose of patient information could result in fines and imprisonment depending on the severity of the event.

Identity Theft and assumption Deterrence Act of 1998

This law makes it a federal crime for anyone knowingly using the identity of another person with the intent to engage in unlawful activity. A company could be liable for not properly protecting an individuals private information by improperly disposing of their personnel information.

Gramm-Leach-Bliley Act of 1999

Financial institutions must insure the security and confidentiality of their customers. They must also protect against any unauthorized access or use of important information. Financial institutions can be subject to heavy fines and even imprisonment for its officers and directors.

Fair and Accurate Credit Transaction Act  of 2003 - FACTA

This act is designed to reduce the risk of consumer fraud & identity theft by improperly disposing of consumer information. Any person who maintains or otherwise possesses consumer information for a business person must properly destroy discarded consumer information.


The first thing you have do is to determine if the material you are disposing of will put you or your company at risk if that information would fall into the wrong hands.
